Brazil MAPA Issued Ordinance on Automatic RET of Pesticide Based on Existing Active Ingredient

On 6 April 2016, the Secretariat of Agricultural Defense of MAPA (Ministry of Agriculture, Livestock and Supply) published an ordinance regarding automatic registration of pesticide for research and experimental purpose. The technical product, pre-mixture, pesticide and similar product only containing active ingredient(s) already registered in Brazil will be automatically granted with the Special Temporary Registration (RET) by MAPA.

The automatic RET will be valid for 3 years and nonrenewable.

The research and experimentation of a technical product, pre-mixture, pesticide and similar product containning active ingredient which do not yet registered in Brazil or modification the composition, tank mix utilization and used on a new crop/target subject to registration alteration formality of a registered pesticide should obtain a Special Temporary Registration (RET). According to the study plan and the product, the research and experiment are classified into three stages:

Preliminary  implementation in laboratory, vegetation room, greenhouse, water box, water tank by an accredited experimentation station;

Scale-up implementation in pond, closed lake and plot by an accredited experimentation station;

Final implementation in accredited experimentation station or area of a third party by contract agreement, assignment or technical cooperation;

Technical product and pre-mixture are framed in Phase I  at all times. The experimentation station engaged in the study on agricultural, forest and pasture pesticide should be accredited by the MAPA and registered under the Federal Technical Cadastral with the IBAMA. The agricultural product and remaining crops from the area treated with pesticide under RET cannot be used for human or animal consumption and should be destructed accordingly. Except that the pesticide was nature enemy or utilized without contacting the crop and soil.
