Public Comments on 5 Draft Supporting Rules for China New Pesticide Regulation
  • All inert ingredients added prior to finall uses(ajduvant) will require additional testing data

  • Natural enemy, naturally occurring elements and other low risk pesticides will only need to file a record with MoA

  • OEM of pesticide can only be utilized by Chinese domestic manufacturers while overseas companies can subcontract a Chinese domestic manufacturer to sub-package/repackage;

  • Mandatory recycling of Pesticide containers will be implemented in China;

On 27th Apr 2017, China MoA issued an announcement opening up a 30-day public comment period on 5 draft supporting rules for China’s new pesticide regulation ( see news on 1 April ) .

Compared with the initial version drafted by the MoA, several operational issues were ultimately changed or explicitly defined:

Contract Manufacturing – Only domestic Chinese pesticide production enterprises are allowed to use an OEM manufacturer who has not yet obtained the pesticide registration while overseas companies may only subcontract a licensed Chinese domestic manufacturer to sub-package/repackage imported pesticides

Filing Management on Low Risk Pesticide - Natural enemy, naturally occurring elements and other low risk pesticides will only need to file a record with MoA, who will further prescribe the product scope and requirements separately.

Inert Ingredients- the initial drafts required that inert ingredient(ajduvant)  exclusively used for formulation would require additional testing data. In the second draft, the scope has been extended from “exclusively” to all inert ingredient(ajduvant)(ajduvant).

Multiple Compound Formulation - pesticide containing multiple active ingredients will be discouraged from pesticide registration. If necessary, the maximal number of active ingredients will be 2 for general pesticide and 3 for herbicide, seed treatment and pheromone, etc

Mandatory Package Recycling – Pesticide users will be instructed to return empty containers to the sales stores, which should have enough space for temporary storage. Pesticide production enterprises which fail to recycle and dispose of these containers will have their production license revoked.
